Transfer Of Property By Way Of Sale Deed
In Silvassa, transferring property ownership through a sale deed is governed by the Transfer of Property Act, 1882. A sale deed is a legal document that records the transfer of property from the seller to the buyer in exchange for a monetary consideration. It must be executed on non-judicial stamp paper of the value prescribed by the Stamp Act of the respective state. The document must include details such as the names and addresses of the buyer and seller, a complete description of the property, the sale consideration, payment terms, possession date, and any encumbrances on the property.
The sale deed must be signed by both parties in the presence of at least two witnesses. After execution, the deed must be registered at the local sub-registrar office within four months of execution, as per the Registration Act, 1908. Both parties must be present during registration, along with their identity proofs and photographs. Upon successful registration, the buyer becomes the legal owner of the property, and the seller must hand over all original title documents to the buyer.
